Terms of Service

These Terms of Service ("Terms") govern your access to and use of Vive Velo — the website at vivevelo.com and the Vive Velo application (together, the "Service"). The Service is operated by Speelman Consulting LLC, a Pennsylvania limited liability company ("Vive Velo," "we," "us"). Please read these Terms carefully.

1. Acceptance of These Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Vive Velo lets you ride real roads indoors: virtual cycling on routes built from real-world road and elevation data, structured workouts, and smart-trainer control. A free tier is available, and some features require a paid subscription. Current plans and pricing are shown on our pricing page.

3. Your Account

• You must be at least 13 years old to create an account.
• You agree to provide accurate information and keep it up to date.
• You are responsible for safeguarding your password and for all activity under your account. Tell us promptly at hello@vivevelo.com if you suspect unauthorized use.

4. Subscriptions & Billing

• Paid subscriptions are billed monthly through our payment processor, Stripe, and renew automatically until cancelled.
• You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
• We may change subscription prices with advance notice. Continued use after a price change takes effect constitutes acceptance of the new price.
• Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods.

5. Fitness & Health Disclaimer

Physical exercise carries inherent risks. Consult a physician before beginning any exercise program, and stop exercising immediately if you experience pain, dizziness, or shortness of breath. You use the Service at your own risk, and you are responsible for exercising within your limits. The Service does not provide medical advice.

6. Your Content

You own the rides, routes, and workouts you create ("Your Content"). You grant Vive Velo a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely as needed to operate and provide the Service. Uploads to Strava happen only at your direction. You are responsible for Your Content.

7. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose;
• attempt to gain unauthorized access to the Service or other users' accounts;
• interfere with or disrupt the Service;
• reverse engineer the Service, except to the extent the law permits it;
• scrape, resell, or redistribute the Service or its data without our permission.

8. Third-Party Services

The Service integrates with third-party services, including Stripe for payments and Strava for activity sync. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

9. Intellectual Property

The Service, including its software, design, and branding, is owned by Vive Velo (excluding Your Content). We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. Portions of map data © OpenStreetMap contributors, available under the Open Database License.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, Vive Velo will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Termination

You may stop using the Service or request account deletion at any time by contacting hello@vivevelo.com. We may suspend or terminate your account if you violate these Terms. Sections that by their nature should survive termination (including Sections 6, 10, and 13) survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date on this page, and for material changes we will notify you by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
